Pre-Closing Day Checklist for seller
Please read through these suggestions, failure to prepare can significantly delay a closing.
- Forward a copy of the warranty deed from your purchase of the property to our office.
- Provide our office with a copy of your payoff information on any and all loans secured by your property with the following:
- Account Number for your Loan;
- Lender’s Name, address & telephone number;
- Copy of payment coupon or most recent account statement
- If possible, a copy of the first page of your security deed
- Anticipate in advance any possible problems regarding outstanding tax bills or liens on the property.
- Request a termite clearance letter from your termite company
- Provide all relevant information with regards to your Homeowners’ Association (if applicable)—contact person, yearly or monthly fees, mailing address and any amounts paid or due.
Closing Day Checklist for seller
Please expect the closing to last approximately an hour
- Identification—two forms of identification are required, one must be a driver’s license or other government ID
- Termite clearance
- If you are executing documents on behalf of a corporation bring the corporate seal and original corporate resolution. If you are signing for a Limited Liability Corporation (LLC), bring the LLC seal if you have one, and a copy of your LLC Operating Agreement.
- Bring keys, home warranty documents, garage door openers.
Documents that a seller will sign at a typical closing
- HUD-1 Settlement Statement.
- Acknowledgement, that the closing attorney represents the lender.
- IRS form 1099--reports the sale to the IRS.
- Deed conveying title to buyer--deed may take one of several forms:
- Warranty Deed - warrants title against the claims of all persons;
- Limited or Special Warranty Deed - warrants title against the claims of all person claiming loss as a result of seller's ownership;
- Quit-Claim Deed - contains no warranties as to title.
- Affidavits--Where applicable, seller executes sworn statements relating to:
- name variations or "aliases"
- knowledge of matters relating to the title
- other matters specific to the particular transaction
Post Closing
To complete the closing of the transaction, the closing attorney will do the following:
- Record warranty and security deeds in the county that the land resides
- Return to the lender the completed loan package
- Disburse al funds in accordance with the HUD-1 Settlement Statement
